Below you will find the general terms and conditions that apply to our three pillars within the organization: Performances, Participation, and Education.

General Terms and Conditions – Performances

1. General

1.1 These General Visitor Conditions are used by the Foundation Holland Dance Festival  (hereinafter referred to as Holland Dance Festival).

1.2 These General Visitor Terms and Conditions apply to every agreement between the Holland Dance Festival and a visitor to one of the Holland Dance Festival activities. These General Visitor Terms and Conditions also apply to all actions performed in implementation of this agreement. For the purposes of these General Visitor Conditions, a visitor is defined as any person or legal entity who in any way, directly or indirectly, enters into an agreement with Holland Dance Festival with regard to attending an event to be organized by Holland Dance Festival or one of its partners.

2. Ticket sales/Admission tickets

2.1 All offers, program announcements, communications or otherwise provided information and quotations made by Holland Dance Festival are without obligation and Holland Dance Festival accepts no liability for any errors in the aforementioned statements. Holland Dance Festival also accepts no liability for errors made during the (pre-) sale of tickets by third parties, including so-called pre-sale addresses and partner theaters.

2.2 If requested, the visitor is at all times obliged to show his/her admission ticket and any card entitling him/her to a discount on this admission ticket to identified officials of the theater or location where the event takes place.

2.3 The visitor is not entitled to a refund of the entrance fee or any other compensation in the event of loss or theft of his/her entrance ticket. In the event that the visitor has obtained the admission ticket from a third party other than the Holland Dance Festival or a partner theater/official sales address and delivery does not take place for reasons on the part of the third party, the visitor is also not entitled to a refund.

If the Visitor does not use the admission ticket for whatever reason, this will be at his/her own expense. In these cases, the entrance fee will also not be refunded. An admission ticket once obtained can - provided there is sufficient availability of tickets - be exchanged for an admission ticket for another Holland Dance Festival activity for a fee of € 3.50 per transaction.

2.4 The visitor is obliged to keep the admission ticket for an event for himself and therefore not to resell it to third parties in any way, to offer it for sale or to offer or provide it for commercial purposes.

2.5 When paying by credit card, it will be charged immediately.

3. Stay in the building where Holland Dance Festival organizes an activity

3.1 During his/her stay in the building where Holland Dance Festival organizes an activity - hereinafter referred to as the theater - the visitor must behave in accordance with public order and the rules of decency applicable to the nature of the event attended. . In this context, the visitor is also obliged to follow the directions and instructions given by the theater officials identified as such. If, in the reasonable opinion of a manager of the theater, the visitor acts in any way contrary to these standards, instructions or instructions, the visitor may be denied further access to the theater for the event in question, without the visitor having any right. can claim reimbursement for his/her admission ticket.

3.2 The visitor is, among other things, prohibited from bringing into the theater or carrying with him objects or substances that are dangerous and/or bothersome to the visitors in the opinion of a theater official;

3.3 The visitor is prohibited from making and using photo, video, film, sound and other recording equipment without prior written permission from the management of the theater or the organization.

3.4 The theater reserves the right to make image and/or sound recordings of the event at which the visitor is present. Photos and film recordings can be used for the Holland Dance Festival archive, the theater and/or publications for promotional purposes. If the visitor does not grant permission for (external) publication, Holland Dance Festival and/or the theater will be notified in writing in advance.

4. Liability of the building where Holland Dance Festival organizes an activity

4.2 The theater is only liable for (consequential) damage suffered by the visitor or injury caused to the visitor, which is directly and exclusively the result of intent or gross negligence on the part of the theater and/or its officials, on the understanding that only that damage is compensation is eligible for which the theater is insured or, in reasonableness and fairness, should have been insured and for the maximum amount applied therein. The theater's liability is excluded for, among other things:

  • damage resulting from the actions of third parties, including persons engaged by the theater and tenants of (spaces in) the building and the persons engaged by these third parties;
  • damage resulting from failure to follow instructions given by the theater officials and from failure to comply with the generally applicable rules of decency;
  • (consequential) damage as a result of unforeseeable changes in the starting and closing times of the events to which the agreement between the theater and/or Holland Dance Festival and the visitor relates;
  • damage in any way caused by other visitors.

4.3 The theater is never liable for damage suffered by the visitor as a result of force majeure on the part of the theater and/or Holland Dance Festival. Force majeure also includes any circumstance independent of the will of the theater and/or Holland Dance Festival that temporarily or permanently prevents fulfillment of the agreement, as well as, insofar as not already included, war, acts of war, civil war, riots, actions of police and/or fire brigade, strike, transport difficulties, fire and other serious disruptions in the operation of the theater or in the buildings, weather conditions and non-functioning public transport for whatever reason.

5. Complaints

5.1 Complaints about the execution of the agreement between the theater and/or Holland Dance Festival and the visitor must reach the theater management by e-mail or registered letter within eight days after the execution of the agreement has taken place or should have taken place. . Complaints submitted after this period will not be processed by the theater and/or Holland Dance Festival.

5.2 The following complaints and circumstances, and therefore never lead to any obligation to pay compensation on the part of the theater and/or Holland Dance Festival:

  • complaints and circumstances relating to changes in the program, including changes in the person(s) of performers, in the composition of the program, shifts of events to another date;
  • complaints and circumstances relating to the quality of the performances of the events to which the agreement between the theater and/or Holland Dance Festival and the visitor relates;
  • complaints and circumstances relating to nuisance or inconvenience caused by other visitors or unlawful intruders, including, but not limited to, noise pollution, inappropriate behavior, theft and molestation; in the event of repeated nuisance or inconvenience caused by certain visitors to be identified, the theater will do everything possible to deny access to these visitors in the future, if necessary;
  • complaints and circumstances relating to nuisance or inconvenience caused by maintenance work on the theatre/building, or the consequences of this maintenance work that could reasonably be carried out at that time;
  • complaints and circumstances relating to nuisance or inconvenience caused by the improper functioning of facilities in the halls of the theater/building;
  • complaints and circumstances relating to nuisance or inconvenience, including limited visibility for the visitor, caused by (sound) recordings by the media and the technical facilities taken in the rooms as a result;
  • complaints and circumstances relating to (noise) nuisance caused by events taking place simultaneously, including necessary actions that serve in preparation for these events, or that are in any other way related to these events, in other areas of the theater/building;
  • complaints and circumstances relating to the allocation and distribution of places and/or a change to the seating plan necessary due to circumstances;
  • complaints and circumstances relating to nuisance or inconvenience, including limited view of the stage and surtitles;
  • complaints and circumstances relating to the presence or absence of surtitles, caused by the improper functioning of the technical facilities, or the theater's choice whether or not to offer that facility;
  • complaints and circumstances relating to nuisance or inconvenience caused by public transport strikes;
  • complaints because the visitor has been denied access to the hall due to the circumstances that the event has already started in this hall.


6. Personal data

6.1 Data relating to the visitor, including data relating to the name, address, place of residence and e-mail address of the visitor, which is registered by the theater and/or Holland Dance Festival in connection with the issuance of an admission ticket, will be included in a registration, the Theater and/or the point of sale is the holder of this registration.

6.2 The visitor may be asked to identify himself by the theater and/or Holland Dance Festival. If the visitor cannot show identification or refuses to show it, he or she may be denied/refused access to the theater.

7. Rights of the Theater

7.1 In the event of violation by the visitor of (one or more of) the provisions stated in these general terms and conditions, the Theater and/or Holland Dance Festival is entitled to invalidate the admission ticket or to refuse the visitor (further) access to the event without this the visitor is entitled to a refund that he has paid to the theater for the admission ticket (including service costs), whether or not via a (advance) sales address.

7.2 If it is likely that the admission ticket has been forged, the theater and/or Holland Dance Festival is entitled to refuse the holder of this admission ticket (further) access to the event, without the visitor or this holder being able to claim any compensation. any damage he will suffer as a result.

8. Other conditions / arrangements

8.1 The theatre's own (contractual) conditions and/or arrangements.

9. Applicable law / competent court

9.1 Dutch law applies to these General Visitor Terms and Conditions and to the agreement between the visitor and/or Holland Dance Festival.

9.2 All disputes arising from the agreement between the visitor and the theater will be submitted for exclusive adjudication to the competent court.

General Terms and Conditions – Participation 

1. General

1.1 These General Terms and Conditions relate to the activities of the Foundation Holland Dance Festival, hereinafter referred to as Holland Dance Festival, in the field of participation and amateur art in the form of lessons, workshops and auditions.

1.2 Holland Dance Festival has expertise in the field of dance and guarantees a high-quality program in terms of content.

2. Cancellation Policy

2.1 If the participant cancels participation in lessons or workshop(s), Holland Dance Festival will charge a percentage of the agreed amount based on the conditions below:

2.2 Cancellation within 3 weeks before the start of the lessons or workshop(s) is not possible, the total amount for participation is non-refundable.

2.3 If you cancel between 6 and 3 weeks before the start of the lessons or workshop(s), 50% of the total amount for participation will be refunded.

2.4 In case of cancellation up to 6 weeks before the start of the lessons or workshop(s), 15% administration costs of the total amount for participation will be deducted from the amount to be refunded.

2.5 Cancellation by the participant must be made by a signed letter or e-mail.

2.6 Lessons or workshops may be canceled if there are fewer than 12 participants. If that is the case, participants who have already registered will receive a refund of the total amount for participation or they can choose another activity/lesson from the Holland Dance Festival offering in consultation.

2.7 If Holland Dance Festival cancels parts of the composite program due to unforeseen circumstances (e.g. illness of teachers), a suitable alternative activity and/or a catch-up time will be chosen.

2.8 There are no refund options for auditions.

3. 3. Compensation and payment

3.1 Payment for the lessons/workshops is made via I-deal or credit card via the reservation procedure on the Holland Dance Festival website. When paying by credit card, it will be charged immediately.

3.2 If the participant wishes to receive a VAT invoice as proof of payment, a request must be sent by e-mail to Holland Dance Festival. The proof of payment will be sent to the participant by e-mail.

3.3 If a participant has not paid before the start of the first lesson, administration costs of € 5 will be charged and the possible discount will expire.

4. Ooievaarspas

4.1 Holders of a valid Ooievaarspas can participate in lessons and workshops at a reduced rate. The specific conditions and discount prices are stated per course on the Holland Dance Festival website.

4.2 Ooievaarspas discount is only granted after digitally reading the Ooievaarspas at the lesson location.

5. Liability/Indemnification

5.1 Holland Dance Festival will be informed in advance of any relevant medical problems of the participant in lessons or workshops.

5.2 Holland Dance Festival is not liable for injuries sustained or accidents during lessons or workshops.

5.3 Holland Dance Festival is also not liable for theft and/or loss of personal property.

6. Photo, film and publication

6.1 When registering, the participant automatically gives Holland Dance Festival permission for photo or film recordings to be made during the lessons or workshops. The photos and film recordings can be used for the Holland Dance Festival archive and publications for promotional purposes.

6.2 If the participant does not grant permission for (external) publication, Holland Dance Festival will be notified in writing in advance.

 

General Terms and Conditions – Education


1. General

1.1 These General Terms and Conditions relate to the activities of the Holland Dance Festival Foundation, hereinafter referred to as Holland Dance Festival, in the field of education and training.

2. Workshops and lessons

2.1 Holland Dance Festival has expertise in the field of dance education and guarantees a high-quality program in terms of content.

2.2 Holland Dance Festival puts together a suitable program in consultation with the school and draws up a lesson schedule.

2.2.1 The school ensures that a supervisor from the school is present at every lesson to provide (practical) support to the dance teachers.

2.2.2. The school ensures that teachers invited by Holland Dance Festival can perform their work in a suitable space (to be determined in consultation with Holland Dance Festival).

3. Performance visit

3.1 If performances are attended in an external theater, the school will provide supervisors; For every 10 students, 1 supervisor is available from school.

3.2 Supervisor entrance tickets are free of charge, based on 1 supervisor for every 10 students. If the school wants to deviate from this number, this must be agreed in advance with Holland Dance Festival.

4. Cancellation policy for workshops and lessons

4.1 If the school cancels the agreed work, Holland Dance Festival will charge a percentage of the agreed amount based on the conditions below:

  • In case of cancellation up to 4 weeks before the date of agreed activities: No costs will be charged.
  • In case of cancellation up to 14 days before the date of the agreed activities: 50% of the agreed total amount will be charged;
  • In case of cancellation from 14 days prior to the date of the agreed activities: 100% of the agreed total amount will be charged.

4.2 Cancellation must be made by a signed letter or e-mail from the person authorized to sign and make the decision.

4.3 If Holland Dance Festival cancels parts of the composite program due to unforeseen circumstances (e.g. illness of teachers), a suitable alternative activity or catch-up moment will be chosen in consultation with the school.

5. Cancellation conditions, reimbursement and payment of performance visits in a theater

5.1 The school owes Holland Dance Festival compensation for the work performed, as confirmed in writing by e-mail.

5.2 Holland Dance Festival will send the school an invoice, which will be paid by bank transfer by the school. Or Holland Dance Festival creates a web order that can be paid by the school using the CJP Culture Card.

5.3 The school is bound to the number of students specified up to 1 week before the start. Tickets will be charged to the school for the number of students known to Holland Dance Festival.

5.4 If primary schools have booked performances via the Cultuur Schakel / Vonk, Article 12 does not apply, but the school must report the number of students via the booking system of the Cultuur Schakel. Changes can be communicated until September 14, 2017 without financial consequences (the number of students can still be adjusted downwards or upwards). The final number of students for whom payment must be made will be determined on September 14, 2017. Changes after this date will be charged as follows:

Payment will be made for at least the number of students registered before September 14, 2017.
If more students arrive after September 14, 2017, they will be charged.
5.5 The school always provides the final exact number of students and supervisors in connection with the room capacity (whether or not the number of visitors is appropriate).

6. Photo and film

6.1 The school allows Holland Dance Festival to make photo or film recordings during the workshops. The photos and film recordings can be used for the Holland Dance Festival archive and publications for educational purposes.

6.2 The school ensures that Holland Dance Festival is informed if certain children are not allowed to appear on screen and makes this known in writing.

7. Liability/Indemnification

7.1 Holland Dance Festival will be informed in advance of any medical problems of students participating in lessons, workshops and/or performance visits.

7.2 Holland Dance Festival is not liable for injuries sustained or accidents during lessons or workshops.

7.3 Holland Dance Festival is also not liable for theft and/or loss of personal property.
